Editrice Shalom S.r.l. invites users to carefully read, before purchasing products and/or services through the website www.editriceshalom.com, these General Terms and Conditions of Sale, which govern the terms and conditions of every purchase made through the website and of which the submission of an order by the Customer presupposes full knowledge and complete acceptance. The General Terms and Conditions of Sale currently in force may be consulted at any time by accessing the “General Terms and Conditions of Sale” link on the homepage of the website www.editriceshalom.com, saved electronically and/or printed.
These General Terms and Conditions of Sale (hereinafter “General Terms” or “CdV”) govern the purchase of products and services, carried out remotely and made available via the internet through the website www.editriceshalom.com (hereinafter also the “Site”).
1.1 The products, digital content and services available through the website www.editriceshalom.com are offered and sold by:
Editrice Shalom S.r.l., with registered office at Via Galvani no. 1, 60020 Camerata Picena (AN), tax code, VAT number and registration number in the Ancona Companies Register 01394390429, registered in the Ancona Economic and Administrative Index under no. AN-128661 (hereinafter also “Seller” or “Editrice Shalom”).
1.2 The Customer may contact the Seller using the following contact details:
1.3 The Seller operates in the course of its business activities and, in its relations with Consumer Customers, qualifies as a professional pursuant to Article 3, paragraph 1, letter c), of Legislative Decree no. 206 of 6 September 2005, known as the Consumer Code.
1.4 The Seller's identifying details and contact information are made available on the Site and may be updated if corporate or organizational changes occur. The details and General Terms communicated at the time the order is submitted shall apply to individual Purchase Contracts.
2.1 For the purposes of these General Terms of Sale, the terms set out below, used in the singular or plural, have the meaning specified herein:
2.2 The titles of the articles and paragraphs are for descriptive purposes only and do not affect the interpretation of these General Terms and Conditions.
2.3 Unless the context indicates otherwise, references to legislative or regulatory provisions shall be understood as referring to the same provisions as subsequently amended, supplemented, or replaced.
3.1 These General Terms and Conditions of Sale govern the offer and sale of the Products carried out by the Seller through the Website, as well as the related Purchase Contracts concluded remotely with Customers.
3.2 These General Terms and Conditions apply both to purchases made by Consumer Customers and to purchases made by Professional Customers. Provisions that, by express statutory provision or by their content, are reserved for Consumer Customers shall apply exclusively to the latter.
3.3 The status of Consumer Customer or Professional Customer is determined based on the purpose for which the Customer makes the purchase. Before submitting the Order, the Customer must provide complete, truthful, and accurate information and indicate whether the purchase is made in the course of their entrepreneurial, commercial, artisanal, or professional activity.
3.4 Relations with Consumer Customers shall be governed by Legislative Decree No. 206 of 6 September 2005, known as the Consumer Code, and by the other national and European Union provisions protecting consumers.
3.5 The rights granted to Consumer Customers by mandatory provisions of law may not be excluded or limited by these General Terms and Conditions and, in the event of a conflict between a provision contained herein and a mandatory rule protecting consumers, the latter shall prevail and the conflicting clause shall be ineffective against the Consumer Customer to the extent of the conflict.
3.6 Unless a more favorable provision contained in these General Terms and Conditions or agreed in writing with the Seller expressly provides otherwise, Professional Customers shall not be subject to the provisions reserved by law for consumers, including those concerning the right of withdrawal, the statutory conformity guarantee provided for by the Consumer Code, and the consumer forum.
3.7 Purchases made by resellers, distributors or other business operators may be governed by specific B2B terms of sale, price lists, commercial agreements or special terms. In the event of a conflict, the terms specifically accepted by the Professional Customer shall prevail over these General Terms and Conditions solely with regard to the matters they regulate.
3.8 Any deviations from these General Terms and Conditions are valid only if made in writing and accepted by the Seller, subject to compliance with the applicable mandatory provisions.
3.9 These General Terms and Conditions do not govern the sale of products or services offered by third parties that may be accessed through links, banners or other references on the Website. Before making purchases from third parties, the Customer must review their contractual terms and the information about the seller.
3.10 Browsing the Website does not, in itself, constitute acceptance of these General Terms and Conditions. The Customer must review them before submitting the Order and accept them in accordance with the procedures provided for in the purchasing process.
4.1 Through the Website, the Seller offers for sale Products belonging, by way of example, to the following categories:
4.2 The essential characteristics of each Product are described in the relevant product information page on the Website. Before submitting the Order, the Customer must review the Product description, price, any available variants, the methods of use or enjoyment, and any other information relevant to the purchase.
4.3 The descriptions, images, photographs, illustrations, graphic representations and any audiovisual content published on the Website are intended to represent the Products as faithfully as possible. However, minor differences may occur, particularly with regard to colours, shades, apparent dimensions, covers, packaging or graphic elements, also due to the settings and technical characteristics of the device used by the Customer.
4.4 Images and graphic representations do not replace the information concerning the essential characteristics of the Product provided in its information sheet. The rights of the Consumer Customer remain unaffected if the delivered Product does not conform to the description, model, sample, or contractually specified characteristics.
4.5 The Seller takes reasonable measures to ensure that the descriptions, characteristics, and other information published on the Site are correct and up to date. Any typographical errors, merely formal inaccuracies, or non-substantial differences that do not affect the essential characteristics of the Product will be corrected as soon as they are detected, without prejudice to the rights granted to the Customer by law and these General Terms and Conditions.
4.6 The availability indicated on the Site is updated based on the information in the Seller’s management systems, but may change even within a short period, particularly when multiple Customers purchase the same Product simultaneously. Adding a Product to the cart does not reserve it and does not guarantee that it will remain available until the Contract is concluded.
4.7 If, after the Order has been submitted, one or more Products are found to be wholly or partially unavailable, the Seller will promptly inform the Customer by email or via another contact detail provided during the purchase process.
4.8 In the event of unavailability, the Seller may propose the following to the Customer, depending on the circumstances:
4.9 Replacing a Product with an alternative Product, changing the delivery times, or partially fulfilling the Order requires the Customer’s consent, unless partial fulfillment was expressly accepted during the purchase process.
4.10 For unavailable Products that will not be supplied, the Seller will not request any payment. If the relevant amount has already been charged or collected, the Seller will refund it without undue delay, generally using the same payment method used for the purchase, unless otherwise agreed with the Customer, provided this does not entail additional costs for the Customer.
4.11 For Digital Content and Digital Services, the relevant information sheet indicates, where applicable:
4.12 Before submitting the Order, the Customer must verify that their device, internet connection, operating system and any programs used meet the technical requirements clearly indicated in the information sheet for the Digital Content or Digital Service.
4.13 The provisions of the preceding paragraph do not limit the Seller's liability if the Digital Content or Digital Service does not conform to the contractual requirements or if the technical information provided before purchase is inaccurate or incomplete.
4.14 The Seller may update, modify, suspend or remove from the catalog Products that are not yet covered by a concluded Contract. Such changes do not affect Orders already accepted or rights acquired by the Customer.
4.15 The special conditions relating to subscriptions, Digital Content and Digital Services are set out in their respective information sheets and in the specific provisions of these General Terms and Conditions.
5.1 The Seller may offer, through the Website, subscriptions to magazines, periodicals, publishing series, printed or digital publications, as well as other supplies or services of a periodic or recurring nature.
5.2 Before the Order is submitted, the information sheet for each subscription clearly indicates, where applicable:
5.3 Unless expressly stated otherwise in the information sheet and the Order summary, the subscription is concluded for a fixed term, for the duration indicated at the time of purchase, and automatically ends upon expiry, without the need for cancellation and without automatic renewal.
5.4 The subscription start date is indicated in the information sheet, the Order summary, or the subsequent activation communication. If the Customer is allowed to choose the initial issue, month, or period, the Seller will take the Customer's choice into account, subject to the editorial schedule, the availability of publications, and the technical time required to record payment and activate the subscription.
5.5 If payment or confirmation of the Order takes place after the technical deadline required to include the Customer in the selected distribution cycle, the subscription may begin with the first subsequent issue available. The Seller will inform the Customer thereof without undue delay.
5.6 The number of issues included in the subscription and their frequency are those indicated in the information sheet in force when the Order is submitted. Any publication or delivery dates indicated are estimates, unless they have been expressly designated as essential.
5.7 Any non-substantial changes to the editorial schedule, due to editorial, production, or distribution requirements or events not attributable to the Seller, do not reduce the total number of issues purchased. The Seller informs the Customer when the change significantly affects the duration or regularity of the supply.
5.8 The subscription price is the price indicated on the Website when the Order is submitted and includes applicable taxes. Any delivery charges or other costs are indicated separately before the Order is submitted. The price for the period already purchased may not be changed after the conclusion of the Contract.
5.9 Where automatic renewal is expressly provided for, the relevant clause, the duration of the renewed period, the price or the criteria for determining it, the frequency of charges, and the cancellation procedures are communicated clearly to the Customer before the Order is submitted.
5.10 Automatic renewal does not apply unless it has been expressly indicated and accepted by the Customer. Failure to cancel results in renewal only in the cases and under the terms clearly communicated before the conclusion of the Contract.
5.11 In the event of automatic renewal, the Seller informs the Customer, by email or another electronic means indicated by the Customer, of the upcoming expiry of the subscription, the expected renewal date, the applicable price, and the deadline by which cancellation may be submitted. Where applicable under current legislation, this notice is sent at least thirty days before expiry.
5.12 If the Seller fails to provide the mandatory advance notice regarding automatic renewal, the Consumer Customer may exercise the remedies provided by applicable law, including, where provided by law, the right to withdraw from the renewed contract without charge until the next expiry date.
5.13 The Customer may prevent automatic renewal by following the procedures indicated in the information sheet, the Order confirmation, or the personal area. The cancellation may also be sent to the e-mail address ordina@editriceshalom.it, stating at least the name of the account holder and the Order or subscription number.
5.14 Unless otherwise provided for more favorably, cancellation prevents renewal for the subsequent period but does not result in the early termination of a subscription already paid for and in progress. The Consumer Customer’s right of withdrawal and other remedies provided by law and these General Terms and Conditions remain unaffected.
5.15 Any changes to the price or conditions applicable to a subsequent renewal period are communicated to the Customer sufficiently in advance. The Customer may prevent renewal in accordance with the procedures indicated in the communication. The changes do not affect the subscription period already purchased.
5.16 The Customer may purchase a subscription for a third party, providing during the purchase process the information necessary for delivery or activation, guaranteeing that they are authorized to communicate such information and undertaking to provide complete and accurate information.
5.17 For a subscription purchased as a gift:
5.18 If a publication is permanently discontinued, suspended for a significant period, or can no longer be provided, the Seller informs the Customer and, depending on the circumstances:
5.19 For subscriptions relating to Digital Content or Digital Services, the access methods, technical requirements, availability period, any updates, and usage limitations are indicated in the relevant information sheet and in the specific provisions of these General Terms and Conditions.
5.20 The Consumer Customer's right of withdrawal is governed by the articles of these General Terms and Conditions concerning withdrawal and by the relevant information published on the Website. Cancellation of the renewal and the right of withdrawal are distinct legal concepts: the former generally prevents renewal for the subsequent period, while the latter results in termination of the Contract in the cases, within the time limits, and with the effects provided for by law.
6.1 The Customer may make purchases through the Website after registering a personal account or, where the relevant function is available, without registration, using the guest checkout procedure.
6.2 Account registration is free of charge, and the Customer must follow the procedure available on the Website and provide the requested information, undertaking to provide complete, truthful, accurate, and up-to-date data.
6.3 The Customer must have the legal capacity necessary to enter into the Contract. A minor or person lacking full capacity to act may use the Website and make purchases exclusively through their parent, guardian, or other legally authorized representative.
6.4 During registration, login, or purchase, the Customer may be required to use a password, a temporary code, an authentication link, or another identification tool made available by the Website.
6.5 Credentials and authentication tools are personal and must not be disclosed or made available to third parties. The Customer must safeguard them diligently and take reasonable measures to prevent their unauthorized use.
6.6 The Customer must promptly inform the Seller if they become aware of or suspect:
The notification may be sent using the contact details indicated in Article 1 of these General Terms and Conditions.
6.7 Until notification is received, the Customer is liable for activities carried out through their account only to the extent that such activities are attributable to them. The Customer shall not be liable for unauthorized access or use resulting from circumstances attributable to the Seller, vulnerabilities in the Website's systems, or other circumstances unrelated to the Customer's conduct.
6.8 The Customer is responsible for the accuracy of the data provided during registration and the purchase procedure. The Seller is not liable for delays, inability to deliver, or other consequences arising from inaccurate, incomplete, or outdated data attributable to the Customer, without prejudice to any otherwise applicable mandatory provisions of law.
6.9 A registered Customer may access their personal area to use the features made available by the Site, including, by way of example:
6.10 The features actually available in the personal area may vary depending on the type of account, Product, or service used. The modification or removal of ancillary features does not affect Contracts already concluded or rights acquired by the Customer.
6.11 Guest purchase allows an Order to be submitted without creating a personal account. In this case, the Customer must provide the data necessary to conclude and perform the Contract, including the contact details to which the Order confirmation and subsequent communications are to be sent.
6.12 A Customer who purchases as a guest may be unable to directly view their Order history or use other features reserved for registered users. Information relating to the purchase will nevertheless be provided on a Durable Medium and may be requested from customer service, subject to reasonable verification of the requester's identity.
6.13 Creating an account after making a purchase as a guest does not automatically result in the association of previous Orders with the account. This association may be made when the feature is technically available and after verification of the purchaser's data.
6.14 The following are not permitted:
6.15 The Seller may temporarily suspend access to the account when reasonably necessary for security reasons, to prevent fraud, to protect the Customer or other users, or to investigate a breach of these General Terms and Conditions. Where possible and compatible with security requirements, the Customer will be informed of the suspension and how to restore access.
6.16 The Seller may close the account in the event of fraudulent or unlawful use, a serious or repeated breach of these General Terms and Conditions, or at the Customer’s request.
Suspension or closure of the account does not affect:
6.17 The Customer may request closure of their account using any features available in their personal area or by contacting the Seller at the contact details indicated in Article 1. Closing the account does not automatically result in the immediate deletion of all personal data, which will be processed and retained within the limits and for the periods specified in the privacy policy and by applicable law.
6.18 Personal data collected in connection with registration, account management, and purchases made as a guest are processed in accordance with the privacy policy available on the Site.
7.1 To purchase one or more Products through the Site, the Customer must select the Products of interest, indicate any required quantities or variants, and add them to the virtual cart using the relevant function.
7.2 Adding a Product to the cart does not reserve the Product, does not constitute acceptance of the Order by the Seller, and does not guarantee that the Product will remain available until completion of the purchase procedure.
7.3 Before proceeding with the purchase, the Customer may view the contents of the cart and, using the functions available on the Site:
7.4 To complete the purchase procedure, the Customer must log in to their account or, where available, proceed as a guest, as provided for in Article 6 of these General Terms and Conditions.
7.5 The Customer must therefore provide or confirm the information requested by the Website, including, where applicable:
7.6 The Customer must verify that the information entered is complete, truthful, accurate, and up to date. In particular, they must carefully check the delivery address, contact details, tax information, and payment information.
7.7 Before the final submission of the Order, the Website makes available to the Customer a summary clearly and comprehensibly setting out the main information relating to the purchase, including, where applicable:
7.8 The Customer must review the Order summary before submitting it. Until that time, they may return to the previous stages of the procedure and correct errors using the editing controls available on the Website.
7.9 In particular, the Customer may:
7.10 If the Website indicates that data are missing, formally incorrect, or incompatible with the selected delivery or payment method, the Customer must correct them before being allowed to proceed. The automatic checks carried out by the Website do not exempt the Customer from the obligation to personally verify the accuracy of the information entered.
7.11 Before submitting the Order, the Customer must be able to review these General Terms and Conditions, the Information on the right of withdrawal, and the Privacy Policy through easily accessible links and in a way that allows them to be stored and reproduced.
7.12 Where required by the purchase procedure, the Customer must declare that they have read and accepted these General Terms and Conditions using the relevant function. Acceptance of the clause concerning the processing of personal data does not concern optional consents for promotional purposes, which must be requested separately and may not constitute a necessary condition for making the purchase.
7.13 In the case of Digital Content or Digital Services for which the Customer requests that performance begin during the period provided for exercising the right of withdrawal, the procedure may require the declarations and express consents prescribed by law, including, where applicable, acknowledgment of the loss of the right of withdrawal following the commencement of performance.
7.14 The final submission of the Order takes place by activating the relevant button or function available at the end of the purchase procedure. The wording and effects of this function are governed by the subsequent article concerning submission of the Order and the obligation to pay.
7.15 After submitting the Order, any errors that can no longer be corrected directly through the Site must be promptly reported to the Seller using the contact details indicated in Article 1. The Seller will assess the request taking into account the processing status of the Order, without prejudice to the Consumer Customer’s right of withdrawal and other rights to which the Customer is entitled.
7.16 The Seller may update the graphic design and individual stages of the purchase procedure, provided that the clarity of the information, the ability to identify and correct errors before submitting the Order, and the other safeguards provided by applicable law are preserved.
8.1 At the end of the purchase procedure, before the final submission of the Order, the Customer views a clear and comprehensible summary of the purchase-related information, in accordance with the provisions of the preceding article and applicable law.
8.2 Immediately before the Customer submits the Order, the Site highlights, where applicable:
8.3 The Customer must carefully check the Order summary and the total amount due before proceeding with its final submission.
8.4 If the Order entails an obligation to pay, it is submitted by activating a button or similar function displaying, in an easily readable manner, the wording: “Order with obligation to pay” or another corresponding and unequivocal formulation that clearly conveys that submitting the Order entails an obligation to make payment to the Seller.
8.5 The wording of the final button must not be accompanied by ambiguous wording or wording that could lead the Customer to believe that submitting the Order does not entail an obligation to pay.
8.6 By activating the final button, the Customer:
8.7 Submitting the Order creates an obligation for the Customer to pay the price only under the terms provided for in these General Terms and Conditions and subject to the provisions of the following article regarding the time of conclusion of the Contract.
8.8 The technical receipt of the Order by the Seller’s computer system does not necessarily constitute acceptance of the Order or conclusion of the Contract, unless otherwise expressly provided for in these General Terms and Conditions or in the communication sent to the Customer.
8.9 If the Seller fails to comply, vis-à-vis the Consumer Customer, with the obligations relating to the wording of the button or function used to submit the Order, the Consumer Customer is not bound by the Contract or the Order, as provided for by applicable law.
8.10 After the Order has been submitted, the Seller sends the Customer an electronic communication confirming its receipt, in accordance with the procedures set out in the following articles.
8.11 Any technical malfunctions that prevent the summary, total price or wording relating to the payment obligation from being displayed correctly must be reported to the Seller. In such cases, the Customer is invited not to submit the Order until the procedure is functioning correctly again.
9.1 The presentation of the Products on the Website, including their descriptions, images, features and price information, constitutes an invitation to the Customer to submit a purchase offer and not a binding offer to the public by the Seller.
9.2 By submitting the Order in accordance with the procedure set out in the preceding articles, the Customer makes the Seller a contractual offer for the purchase of the Products indicated in the Order summary, under the conditions and at the prices stated therein.
9.3 The Order shall be binding on the Customer within the limits provided by applicable law, without prejudice to the Consumer Customer’s right of withdrawal and other mandatory rights provided by law.
9.4 After the Order has been submitted, the Seller’s system shall send the Customer, without undue delay, an electronic communication confirming receipt of the Order and summarising its essential elements.
9.5 The automated communication acknowledging receipt of the Order confirms only that the Order has been correctly received by the Seller’s IT systems. Unless the communication expressly also indicates acceptance of the Order, it does not constitute acceptance of the Customer’s offer and does not result in the conclusion of the Contract.
9.6 After receiving the Order, the Seller shall verify, in particular:
9.7 The Contract shall be deemed concluded when the Customer receives, at the email address provided during the purchase process, a communication from the Seller containing acceptance of the Order.
9.8 Acceptance may be communicated by means of:
9.9 The Seller may accept the Order in full or, in the cases provided for by these General Terms and Conditions, only for the available Products. Partial acceptance shall be communicated to the Customer, indicating the Products that will be supplied, the corresponding amount and any sums to be refunded.
9.10 If partial fulfilment would result in a substantial change to the Order, the delivery charges or the conditions initially summarised, the Seller shall request the Customer’s consent before proceeding.
9.11 The Seller may refuse to accept the Order, in whole or in part, in the following cases:
9.12 The rejection of the Order may not be based on discriminatory grounds or grounds contrary to mandatory legal provisions. The Seller informs the Customer of the non-acceptance without undue delay via the electronic contact details provided during the purchase process.
9.13 If the Order is not accepted and the corresponding amount has already been charged or collected, the Seller shall refund it without undue delay using the same payment method used by the Customer, unless otherwise agreed without imposing additional costs on the Customer.
9.14 Any authorization, reservation, or provisional charge of the amount by the payment service provider does not, in itself, constitute acceptance of the Order by the Seller.
9.15 These provisions apply unless, for specific Products, Digital Content, Digital Services, or sales methods, the Site clearly indicates a different time of conclusion of the Contract before the Order is submitted.
9.16 The place where the Contract is concluded does not affect the mandatory rights granted to the Consumer Customer, including provisions concerning applicable law and jurisdiction.
10.1 After the Order has been submitted, the Seller sends, without undue delay, a communication to the email address provided by the Customer confirming receipt of the Order by its computer systems.
10.2 The acknowledgment of receipt contains or makes available, clearly and comprehensibly, at least the following information:
10.3 The automated acknowledgment of receipt of the Order does not constitute acceptance of the Customer's offer, unless it expressly and unambiguously also indicates the Seller's acceptance of the Order.
10.4 Where the acknowledgment of receipt does not also contain acceptance, the Seller sends the Customer a subsequent confirmation of acceptance of the Order. The Contract is concluded at the time established by Article 9 of these General Terms and Conditions.
10.5 Once the Contract has been concluded, the Seller provides the Consumer Customer with the relevant confirmation on a Durable Medium within a reasonable period and, in any event:
10.6 The confirmation of the Contract may be included in the same communication by which the Seller accepts the Order, provided that it is sent on a Durable Medium and contains all the information required by these General Terms and Conditions and applicable law.
10.7 The confirmation of the Contract contains or makes available to the Customer:
10.8 In the case of Digital Content supplied by means of a non-material medium or services whose performance begins during the withdrawal period, the confirmation includes, where applicable:
10.9 The Customer must promptly verify the accuracy of the information shown in the receipt and Order confirmation and report any errors or inaccuracies using the contact details indicated in Article 1.
10.10 Reporting an error after submitting the Order does not guarantee that the Order can be modified. The Seller will assess the request taking into account the status of preparation, payment, or shipping, without prejudice to the Consumer Customer's right of withdrawal and other mandatory rights.
10.11 The Contract, the Order, its confirmation and communications concerning its performance are archived by the Seller using computerised and management systems, in compliance with the periods prescribed by civil, tax, accounting and personal data protection legislation.
10.12 A registered Customer may view Orders and the information made available by accessing their personal area, where this functionality is available. The availability of the personal area does not replace the sending of the Contract confirmation on a Durable Medium.
10.13 A Customer who has made a purchase without an account, or who can no longer access their personal area, may request a copy of the contractual documentation from the Seller, providing their name, the Order number and any additional information reasonably necessary to verify their identity.
10.14 The Customer is invited to retain the Order confirmation, these General Terms and Conditions and the other documents received by email or made available in downloadable format.
10.15 The General Terms and Conditions applicable to each Contract are those in force and accepted by the Customer at the time the Order is submitted. Subsequent amendments to the General Terms and Conditions shall not affect Contracts already concluded.
10.16 The Contract is concluded in Italian. The purchasing procedure, these General Terms and Conditions and the contractual documentation are made available in Italian.
10.17 If the Seller makes translations of these General Terms and Conditions or of the purchasing procedure available in other languages, the Website indicates the languages in which the Contract may be concluded. Unless expressly provided otherwise, any translations provided to facilitate consultation are for information purposes only and, in the event of an interpretative discrepancy, the Italian text shall prevail, without prejudice to the non-waivable rights granted to the Consumer Customer.
10.18 The Seller adopts reasonable measures to ensure that the contractual documents sent to the Customer are accessible, storable and reproducible without alteration. Any links included in communications do not exclude the obligation to provide, on a Durable Medium, the information for which this method is required by law.
11.1 The Customer must carefully check the content of the Order and the accuracy of the data entered before submitting it, using the checking and correction functions made available by the Website.
11.2 After submitting the Order, the Customer may request its amendment or cancellation by promptly contacting the Seller using the contact details indicated in Article 1 and providing at least:
11.3 A request to modify or cancel the Order does not guarantee that the Order can be modified or cancelled. The Seller shall assess its feasibility, taking into account when the request was received, the stage of Order processing, whether payment has been made, and any preparation, customization, activation, or shipment of the Products.
11.4 The modification or cancellation of the Order shall take effect only when the Seller sends confirmation thereof to the Customer on a Durable Medium.
11.5 Before the Contract has been concluded, the Seller may accept the request to modify or cancel the Order and, consequently, accept the Customer’s proposal in its modified version or refrain from accepting it.
11.6 After the Contract has been concluded, the Order may be modified or cancelled only by agreement between the Seller and the Customer, without prejudice to:
11.7 If the Order has already been handed over to the carrier, it will normally not be possible to modify its contents, address, or delivery method. The Customer may exercise the rights provided by law and these General Terms and Conditions after delivery, where applicable.
11.8 The availability of the Products indicated on the Website may change even after the Order has been placed, particularly in the event of simultaneous purchases, errors in inventory information, unavailability from suppliers, or events that could not reasonably have been foreseen.
11.9 If one or more Products become unavailable after the Order has been placed, the Seller shall inform the Customer without undue delay, using the email address or other contact details provided during the purchase process.
11.10 In the event of unavailability, the Seller may offer the Customer one or more of the following solutions:
11.11 Product replacement, significant postponement of delivery, and any other substantial change to the Order require the Customer’s express consent. In the absence of consent, the Seller may not unilaterally replace the unavailable Product with a different Product.
11.12 Before the conclusion of the Contract, the Seller may accept the Order only for the available Products, provided that the partial acceptance is clearly communicated to the Customer and does not entail changes to the price, charges, or conditions not previously accepted.
11.13 If the unavailability becomes apparent after the conclusion of the Contract, the Seller shall propose an appropriate solution to the Customer and, if it is not possible to perform the service originally agreed, shall refund the portion of the price relating to the Products not supplied, without prejudice to any additional remedies provided by law.
11.14 Where the partial fulfilment of the Order substantially affects the overall purpose of the purchase, a promotion, a bundled product, or the Customer’s interest in receiving the other Products, the Seller shall ask the Customer whether they intend to:
11.15 If the change requested by the Customer entails a change in the total price:
11.16 In the event of the total or partial cancellation of the Order, the Seller shall not request payment for the cancelled or unavailable Products.
11.17 If the amounts relating to cancelled or unavailable Products have already been charged or collected, the Seller shall refund them without undue delay, using the same payment method used by the Customer for the purchase, unless otherwise expressly agreed and provided that this does not entail additional costs for the Customer.
11.18 In the case of payment by bank transfer, cash on delivery, or another method that does not technically allow automatic re-crediting, the refund may be made by bank transfer or another method agreed with the Customer. For this purpose, the Customer must provide only the information necessary to process the refund.
11.19 Any reservation or temporary authorization of the amount on the card or payment instrument may be revoked or released by the relevant payment service provider in accordance with its technical processing times. The Seller does not charge the Customer any fees for refunding amounts relating to Products not supplied.
11.20 These provisions do not limit the Consumer Customer’s right to use the remedies provided by law in the event of failure to deliver within the agreed period, nor the right to a refund of amounts paid when the Contract is lawfully terminated.
12.1 The prices of Products offered through the Site are expressed in euros.
12.2 Prices intended for Consumer Customers are indicated inclusive of value-added tax, where applicable, unless expressly and clearly stated otherwise due to the nature of the Product or the applicable tax regime.
12.3 If the Site contains areas reserved for Professional Customers in which prices are indicated excluding VAT, this circumstance must be clearly specified. Before the Order is submitted, the applicable VAT, any additional charges, and the total amount due must in all cases be indicated.
12.4 The price applicable to each Product is the price indicated in the relevant information listing and in the Order summary at the time it is submitted, without prejudice to any obvious and recognizable errors governed by these General Terms and Conditions.
12.5 The Seller may modify the prices of Products that are not yet the subject of a submitted Order at any time. Price changes do not affect Orders already submitted and subsequently accepted by the Seller, unless the change is required by law or results from the correction of an obvious error, as provided for in these General Terms and Conditions.
12.6 The price indicated in the Product listing does not include delivery costs or any other additional costs, unless the Site expressly indicates that such costs are included.
12.7 Before the final submission of the Order, the Site clearly and comprehensibly informs the Customer of:
12.8 Delivery costs are calculated based on the criteria indicated on the Site, which may include the destination, weight, dimensions, Order value, chosen delivery method, and any applicable promotional conditions.
12.9 Where delivery charges or other costs cannot reasonably be calculated before the Customer has provided the destination or other necessary information, the Site shall inform the Customer in advance that such costs may be charged. Their amount must nevertheless be shown to the Customer before the Order is finally submitted.
12.10 The Customer is not required to bear any additional costs that were not communicated before the Order was submitted or that were not expressly accepted through an informed choice.
12.11 Any additional paid services or options may not be selected using preselected boxes, commands or settings. The Customer must be able to expressly choose them and remove them before submitting the Order.
12.12 If an additional cost is applied without the Customer's express consent, the Customer is entitled to reimbursement of the amounts improperly charged, without prejudice to any additional rights provided for by applicable law.
12.13 For deliveries to the territory of the European Union, the total cost of the Order includes the taxes and charges that, under applicable law and the conditions indicated on the Site, must be collected directly by the Seller.
12.14 For deliveries to countries outside the European Union, the price and shipping costs shown in the Order summary may not include customs duties, import taxes, customs clearance fees or other charges imposed by the authorities or intermediaries in the destination country.
12.15 Where customs duties, import taxes or other charges relating to deliveries outside the EU are payable by the recipient, this is communicated before the Order is submitted. The Customer must verify whether they apply with the competent authorities in the destination country.
12.16 The Seller cannot quantify or guarantee in advance the amount of charges imposed directly by foreign customs or tax authorities, unless such amounts are expressly calculated and collected during the purchase procedure.
12.17 In the case of subscriptions, recurring supplies, Digital Content or Digital Services, the Site indicates, where applicable, before the Order is submitted:
12.8 Where the Contract provides for variable consideration or consideration whose exact amount cannot be determined in advance, the Seller shall inform the Customer of how the price is calculated and of the factors that may affect the final amount.
12.9 The Order summary indicates the total amount that the Customer will be required to pay if the Seller accepts the Order. The Customer must be able to verify this amount immediately before activating the button bearing the wording relating to the payment obligation.
12.10 The total amount shown in the Order summary takes precedence over the partial amounts previously displayed while browsing, provided that it has been calculated correctly on the basis of the Products, destination, delivery method and options selected by the Customer.
12.11 If the Customer notices a discrepancy between the price indicated on the Product page, the price displayed in the cart and the price shown in the final summary, they are invited not to submit the Order and to contact the Seller for the appropriate checks.
12.12 In the event of an obvious and recognizable error in the price or in calculating the total amount, the Seller promptly informs the Customer before accepting the Order. The Customer may confirm the purchase at the correct price or cancel the Order at no cost.
12.13 If the Contract has already been concluded and the incorrectly stated price does not constitute an obvious error recognizable by the Customer exercising ordinary diligence, the applicable provisions and the Consumer Customer’s mandatory rights remain unaffected.
12.14 The conditions relating to promotions, announcements of price reductions, promotional codes, purchase vouchers and gift cards are governed by the subsequent articles of these General Terms and Conditions.
13.1 The Seller may offer discounts, promotional campaigns, extraordinary sales and other commercial initiatives relating to one or more Products, in compliance with applicable law.
13.2 The conditions of each promotional initiative are communicated to the Customer clearly and comprehensibly. Where applicable, the relevant communication indicates:
13.3 Unless otherwise indicated, promotions are valid exclusively during the communicated period and until the Products intended for the initiative are sold out, if applicable. Early termination due to exhaustion of stocks does not affect Orders already accepted by the Seller.
13.4 When the Seller announces a reduction in the price of a Good compared with the price previously applied, the announcement also indicates the corresponding “prior price”, in accordance with Article 17-bis of the Consumer Code.
13.5 “Previous price” generally means the lowest price applied by the Seller to the general body of consumers during the thirty days preceding the application of the reduction. For purchases made through the Website, the previous price is determined by reference to the prices applied in the Seller’s online sales channel, regardless of any prices applied at physical stores or through other sales channels. The previous price is indicated near the promotional price, in a clearly legible manner that enables the Customer to understand the actual extent of the reduction.
13.6 Promotions subject to particular conditions, such as, by way of example, loyalty programs, personal offers, discount vouchers, vouchers, prize promotions, linked sales, quantity discounts or benefits reserved for certain categories of Customers, are governed by the specific conditions of the initiative.
13.7 The special regulations currently in force concerning book prices apply to price reductions relating to books. The reference price is the final consumer price set and affixed by the publisher or importer. Discounts and promotional campaigns are applied exclusively within the limits, for the periods and in the cases permitted by the special sector-specific rules.
13.8 When a promotion includes both books and Products belonging to other categories, the Seller applies separately:
13.9 The price applicable to the Customer is the price indicated in the Order summary before its final submission, including any discounts and promotions validly applied. Adding a promotional Product to the cart does not reserve the price or the Product. The Customer benefits from the promotion if it is still valid and applicable when the Order is submitted.
13.10 If, due to a technical malfunction or clerical error, the discount is not applied correctly, the Customer is invited not to submit the Order and to contact the Seller. If the Order has already been submitted, the provisions of these General Terms and Conditions relating to pricing errors and the conclusion of the Contract shall apply.
13.11 Promotions cannot be converted into cash and do not entitle the recipient to receive any amounts or additional credits beyond the economic benefit expressly provided for and, unless otherwise indicated in the conditions of the individual initiative, discounts, promotional codes, shopping vouchers and other benefits cannot be combined with one another.
13.12 The return of one or more Products purchased as part of a promotion may result in the financial benefit being recalculated when the conditions on which the discount was subject are no longer met. The recalculation must be carried out transparently and may not limit the Consumer Customer’s right to the refund provided for by the regulations on withdrawal.
14.1 The Seller may issue and make available to Customers promotional codes, purchase vouchers, gift cards, and other instruments that allow them to obtain a discount on the price or use a specific value to purchase Products available on the Site. The conditions applicable to each promotional code, purchase voucher, or gift card are communicated to the Customer before purchase or use and indicate, where applicable:
14.2 Promotional codes
14.2.1 The promotional code gives the Customer the right to benefit from the discount or financial benefit indicated in the relevant communication, provided that all the conditions of the promotion are met.
14.2.2 Unless otherwise indicated, each promotional code:
14.2.3 The promotional code must be valid when the Order is submitted. Simply entering the code in the cart does not guarantee its application if, before the Order is submitted, its validity period has expired or the conditions of the promotion are no longer met.
14.2.4 The Site displays in the Order summary that the code has been applied and the corresponding financial benefit. The Customer must verify this application before submitting the Order. If the code is not accepted or the discount is not correctly applied, the Customer is advised not to submit the Order and to contact the Seller for the necessary checks.
14.2.5 Personal promotional codes, reserved for or sent to a specific recipient, may not be transferred, published, reproduced, or used by persons other than the beneficiary, unless the terms of the initiative expressly permit their transferability. The Seller may refuse or cancel the use of a code obtained or used fraudulently, abusively, or contrary to the relevant terms, notifying the Customer accordingly and without prejudice to the mandatory rights granted by law.
14.3 Vouchers and gift cards
14.3.1 The voucher or gift card grants the holder the right to use the stated value to purchase eligible Products, within the validity period and according to the terms communicated at the time of issue or purchase. It may be issued in paper or digital format and may be identified by a code, number, electronic link, or other element required for its use.
14.3.2 Unless otherwise indicated, the voucher and gift card may be used exclusively on the Website and may not be used at any physical stores, retailers, or third parties.
14.3.3 Before purchase, the Seller clearly indicates:
14.3.4 The validity period may not be subsequently shortened after issue. Any changes to the terms do not affect vouchers and gift cards already purchased, unless they are more favorable to the holder or required by mandatory provisions of law. Unless otherwise expressly communicated, the voucher or gift card may be used in one or more transactions until its value is exhausted and, in any event, by the expiry date.
14.3.5 If the Order value is lower than the available credit, the unused amount remains available for subsequent purchases until the expiry date, whereas if it is higher than the available credit, the Customer must pay the difference using one of the payment methods available during the purchasing process.
14.3.6 The remaining balance can be checked through the section or feature that may be available on the Website, or by contacting customer service and providing the information required to identify the voucher or gift card.
14.3.7 Unless otherwise provided in the terms of issue or by applicable law, vouchers and gift cards:
14.3.8 The prohibition on conversion into cash does not apply when a refund is required by law, the Seller cancels the issuance, or is unable to allow use of the voucher or gift card for a reason attributable to the Seller.
14.3.9 If the Seller ceases to market the majority of the Products for which the voucher or gift card could be used, the holder is entitled to an equivalent solution or a refund of the unused remaining balance.
14.4 Validity and Expiration
14.4.1 The expiration date is indicated on the voucher, gift card, related electronic communication, or in the terms made available at the time of purchase. Unless otherwise indicated, the validity period begins on the date of purchase or issue. If deferred activation is provided for, the period begins on the date expressly communicated to the Customer. The voucher or gift card must be valid when the Order is submitted. The presence of the instrument in the cart does not suspend or extend its expiration. Upon expiration, the voucher or gift card can no longer be used and any remaining balance is non-refundable, unless otherwise provided by a more favorable condition communicated by the Seller or by mandatory provisions of law. If the voucher or gift card expires while a duly submitted Order is being processed, its validity remains effective with respect to that Order.
14.4.2 If the Order is canceled by the Seller or cannot be fulfilled for a reason not attributable to the Customer, the amount used shall be re-credited to the same voucher or gift card or made available through an equivalent instrument.
14.4.3 If, at the time of re-crediting, the voucher or gift card has already expired or has insufficient remaining validity to allow for reasonable use, the Seller shall extend its validity or issue a replacement instrument of equal value.
14.5 Combining Promotions and Excluded Products
14.5.1 Promotional codes, purchase vouchers, gift cards, and other promotions may be combined only when expressly indicated on the Site or in the terms of the relevant promotion. Unless otherwise indicated, only one promotional code may be used per Order. Multiple purchase vouchers or gift cards may instead be used when this function is permitted by the Site's technical procedure.
14.5.2 The use of promotional codes, purchase vouchers, or gift cards may be excluded for:
14.6 Cancellation, return, and refund of the Order
14.6.1 In the event of total or partial cancellation of the Order by the Seller, the value of the voucher or gift card used for the Products not supplied is recredited or restored without undue delay.
14.6.2 In the event of valid exercise of the right of withdrawal, the refund is made, insofar as possible, using the same instruments used for the original payment:
14.6.3 The Customer incurs no costs for recrediting resulting from the cancellation of the Order or the exercise of a right recognized by law. If the return of certain Products causes the conditions on which a promotional discount depended to no longer be met, the Seller may recalculate the amount of the discount, provided that this consequence was clearly communicated before purchase and does not limit the Consumer Customer's non-waivable rights
14.7 Gifts and transferability
14.7.1 The gift card may be purchased for a third party when this option is provided by the Site. The Customer is responsible for the accuracy of the email address or other information provided for delivery to the beneficiary. Unless designated as named or personal, the gift card may be used by the person who lawfully possesses the code. The Customer and the beneficiary must safeguard the code diligently and must not disclose it to unauthorized persons.
14.7.2 The Seller is not liable for the use of the gift card by third parties who obtained the relevant code due to circumstances attributable to the purchaser or beneficiary. The Seller remains liable for malfunctions, security breaches, or unauthorized use attributable to the Seller.
15.1 Classification and sorting of Products
15.1.1 The Site may allow the Customer to search, filter, and sort the Products available in the catalog using keywords, categories, topics, features, price ranges, or other search criteria.
15.1.2 When the Customer selects a specific criterion, such as ascending price, descending price, publication date, new products, popularity, or rating, the results are ordered primarily according to the selected criterion, without prejudice to the application of any secondary criteria necessary to manage Products having the same value.
15.2 Promotional or Sponsored Placements
15.2.1 Some Products may receive greater visual prominence or a privileged position due to:
15.3 Customer Reviews
15.3.1 When the Site allows reviews of Products to be published or displayed, the Seller provides Customers with clear information on how reviews are collected, verified, published, sorted, and moderated.
15.3.2 The Seller expressly indicates whether the published reviews:
15.3.3 The label “Verified Purchase”, “Verified Customer”, or another equivalent expression is used exclusively when the system or the Seller has reasonably verified that the review author purchased the Product to which the review refers. When a review is not linked to a verified purchase, it is not presented as originating from a Customer who certainly purchased or used the Product.
15.3.4 Verification measures may include, where applicable:
15.3.5 Any verification of the purchase does not constitute the Seller’s approval of the content of the review and does not guarantee that every opinion expressed is objectively correct. Reviews represent the personal assessments of their respective authors.
15.3.6 The Seller does not alter the meaning of published reviews or delete reviews merely because they are negative or critical.
15.3.7 Before removing or not publishing a critical review, the Seller assesses whether it is possible to retain its relevant content by removing only the unlawful or irrelevant parts or those containing personal data.
15.3.8 The Seller may contact the author of the review to request clarification, verify the purchase, handle a report, or allow the correction of content that violates the publication rules.
15.3.9 The Customer may report a review considered fake, unlawful, irrelevant, or contrary to these terms by using the function that may be available on the Website or the contact details indicated in Article 1.
15.3.10 The Seller does not purchase, commission, or publish fake reviews and does not engage third parties to submit inauthentic reviews or endorsements for the purpose of promoting its Products.
15.3.11 Employees, collaborators, suppliers, or parties connected to the Seller may not publish reviews while presenting themselves as independent consumers, unless their relationship with the Seller is clearly disclosed.
15.3.12 If a review was collected as part of a free trial, a complimentary gift, a promotional program, or another incentivized initiative, this circumstance must be clearly indicated near the review. Any benefit may not be conditional on publishing a positive review. The Seller may publish both positive and negative reviews, provided that they comply with the publication rules and come from permitted channels.
15.3.13 Any average rating of a Product is calculated based on the reviews included in the calculation according to the criteria stated on the Website. If certain categories of reviews are excluded or reviews from different sources are used, this circumstance is disclosed to the Customer.
15.3.14 Reviews imported or displayed through external platforms are identified, where technically possible, by indicating the source. The verification methods adopted by the external platform may be described by referring to the information it provides.
15.3.15 Publishing a review does not replace the use of the channels dedicated to assistance, complaints, the right of withdrawal, or the legal guarantee. The presence of a negative review in no way limits the Customer's rights.
15.3.16 The processing of personal data related to the collection, verification, and publication of reviews is carried out in accordance with the Privacy Policy available on the Website.
16.1 The Seller may apply different prices or economic conditions as part of promotions, Customer categories, loyalty programs, agreements, or commercial initiatives, provided that the relevant criteria are transparent, non-discriminatory, and compliant with applicable law.
16.2 Such differences do not, in themselves, constitute price personalization through an automated decision-making process when they depend on general and predetermined conditions applicable to all Customers in the same situation.
16.3 “Price personalized through an automated decision-making process” means a price determined or modified specifically for a particular Customer through the automated processing of information relating to that Customer, such as, by way of example:
16.4 If the price presented to the Customer is personalized on the basis of an automated decision-making process, the Seller informs the Customer clearly and comprehensibly before the Customer becomes bound by the Order.
16.5 Information relating to personalization is shown next to the price or, in any event, in a clearly visible position during the purchase procedure and before the final submission of the Order.
16.6 The communication expressly states that the proposed price has been personalized on the basis of an automated decision-making process. Where necessary to enable the Customer to understand the personalization, the Seller also provides a brief description of the main criteria used, without being required to disclose algorithms, formulas, trade secrets, or information whose disclosure could compromise the security of its systems.
16.7 In the absence of an express indication of personalization displayed before the Order is submitted, the price shown to the Customer shall not be considered personalized on the basis of an automated decision-making process.
16.8 The following do not constitute personalized prices under this article, by way of example:
16.9 The Seller does not use price personalisation to apply discriminatory treatment based on personal characteristics protected by law or to exploit situations of Customer vulnerability in a manner contrary to the principles of fairness and good faith.
16.10 Where applied, the personalised price must be shown in the Order summary together with taxes, delivery charges, any discounts, and the total amount due.
16.11 Price personalisation does not exempt the Seller from complying with provisions relating to:
16.12 Where personalisation involves the processing of personal data, the Seller provides the Customer with the information required by data protection legislation, including, where applicable, information on the logic used, the consequences envisaged, and the data subject’s rights.
16.13 The Customer may request information or clarification about any price personalisation by using the contact details indicated in Article 1 of these General Conditions.
16.14 The Seller may introduce, modify, or discontinue the use of price personalisation systems, ensuring that the information published on the Site and during checkout is updated in advance and corresponds to the actual operation of the systems used.
16.15 Changes to the personalisation criteria do not affect the price of Orders already submitted and accepted by the Seller.
17.1 General provisions
The Customer may pay the price of the Products using one of the methods made available by the Seller during the purchasing process. The payment methods actually available are those displayed at checkout before the Order is submitted.
They may include, by way of example:
The availability of each method may depend on the Order destination, the total amount, the type of Products, the device used, the Customer’s country, the outcome of security checks, and the conditions applied by the relevant payment service provider.
The Customer selects the payment method before submitting the Order and may change it until the final button is activated, from among the available options.
17.1.1 After the Order is submitted, the payment method may be changed only if the change is technically possible and expressly accepted by the Seller. Before the Order is finally submitted, the Site indicates:
17.1.2 The Seller does not apply surcharges for the use of payment instruments where such surcharges are prohibited by law. Any permitted costs are disclosed before the Order is submitted and may not exceed those directly incurred by the Seller for using the relevant instrument.
17.2 Electronic payments and cards
In the case of payment by card, electronic wallet, or another online service, the data necessary for the transaction are transmitted to the payment service provider appointed to manage the transaction. Payment data are processed using security protocols and systems established by the appointed provider. The Seller may receive only the information necessary to determine the outcome of the transaction, manage the Order, issue refunds, prevent fraud, and comply with legal obligations. The Seller does not retain complete card details, unless this is technically necessary, permitted by law, and managed through systems complying with applicable security standards.
The Customer may be required to complete authentication procedures established by the bank or payment service provider, including by means of a temporary code, application, biometric recognition, or another strong authentication element. Failure to complete the authentication procedure, refusal of authorization, or an unsuccessful payment outcome prevents the transaction from being completed.
17.2.1 Depending on the method used and the procedures indicated at checkout, the amount may be:
The time of authorization or charge does not, in itself, determine the conclusion of the Contract, which remains governed by Article 9 of these General Terms and Conditions.
If the Order is not accepted or is cancelled, the Seller will cancel the transaction or refund the amounts collected. The release of any pre-authorization may depend on the technical processing times of the Customer’s bank or payment service provider.
17.3 External payment service providers
Some methods are provided and managed by banks, payment institutions, electronic money institutions or other operators external to the Seller. If the Customer chooses one of these methods, they may be redirected to the external provider’s website or interface and must follow the relevant instructions. The external provider’s contractual terms and privacy notices also apply to the payment service. These terms govern exclusively the relationship relating to the payment service and do not replace these General Terms and Conditions, which continue to govern the sale of the Products. The Seller is not liable for unavailability, delays or malfunctions exclusively attributable to the external provider, without prejudice to the Seller’s obligations relating to performance of the Contract, accurate accounting of the payment and refund of the amounts due.
17.4 Deferred or installment payments
If deferred or installment payment is available at checkout, the relevant service may be provided by an authorized third party separate from the Seller.
Before making a choice, the Customer receives the following information from the service provider, where applicable:
17.4.1 The provision of installment payment may be subject to assessment and approval by the external provider. The Seller cannot guarantee that the request will be accepted and, unless otherwise indicated, does not participate in the relevant creditworthiness assessment. If the installment payment request is rejected, the Customer may select another available method. If no valid payment is made, the Order is not accepted or is cancelled. Any credit or installment payment agreement is separate from the Purchase Contract, without prejudice to the rights granted to the Consumer Customer under the rules governing linked credit agreements.
17.4.2 The exercise of the right of withdrawal from the Purchase Contract and refunds relating to an installment payment are handled by the Seller and the service provider according to their respective responsibilities and applicable law.
17.5 Advance payment by bank transfer
When payment by bank transfer is available, the account details, the deadline for making the payment, and the information to be included in the payment reference are communicated during the purchase procedure or in the Order receipt. The Customer must include at least the Order number and the buyer’s name in the payment reference, unless different instructions are provided. The Order is normally processed after the full amount has been credited and recorded in the Seller’s account.
The time required for a bank transfer to be credited depends on the banks involved and is beyond the Seller’s control. Any fees charged by the Customer’s bank remain payable by the Customer and may not be deducted from the amount owed to the Seller. If payment is not received by the communicated deadline, the Seller may cancel the Order by notifying the Customer. The parties may still agree on an additional deadline. If the bank transfer is for an insufficient amount or does not allow the Order to be identified, the Seller may suspend its processing and ask the Customer for the necessary information or additional payment.
17.6 Cash on delivery
Cash on delivery is available exclusively for the Orders, Products, and destinations indicated at checkout. Before the Order is submitted, the Site communicates:
The Customer must prepare the amount and payment method indicated in the Order confirmation, and the Seller does not guarantee that the carrier can provide change or accept methods other than those expressly communicated.
17.6.1 Cash on delivery may not be available for Digital Content, Digital Services, personalized products, subscriptions, or international shipments.
17.6.2 Unjustified refusal to pay for or receive an Order shipped cash on delivery may result in cancellation of the Contract and the charging of the direct, actual, and documented costs arising from the shipment and return of the Products, within the limits permitted by law.
17.7 Non-payment
The Customer must ensure that they have the funds, authorizations, and instruments necessary to make the payment. In the event of non-payment, incomplete payment, or irregular payment, the Seller may:
The Seller informs the Customer of the problem using the contact details provided during the purchase process. Failure to make payment does not authorize the Seller to apply penalties, interest, or costs that were not previously disclosed or are not permitted by applicable law. In dealings with Business Customers, in the event of late payment, the interest and other remedies provided by law or any specifically accepted B2B terms shall apply.
17.8 Anti-fraud checks
To protect the Customer, the Seller, and transaction security, Orders may be subject to automated or manual checks intended to prevent fraud, identity theft, unauthorized use of payment instruments, and other unlawful activities. The checks may concern, to a proportionate and relevant extent:
17.8.1 When necessary, the Seller may contact the Customer and request supplementary information strictly necessary to verify the legitimacy of the Order and, pending completion of the checks, may temporarily suspend Order processing. If the Customer fails to provide reasonably necessary information or a concrete and documentable risk of fraud persists, the Seller may refuse to accept or cancel the Order, notifying the Customer and refunding any amounts collected.
17.8.2 Checks may not be based on discriminatory criteria or entail arbitrary limitations on the Customer’s rights. Data processed to manage payments and prevent fraud is used and retained in compliance with the Privacy Policy and applicable personal data protection laws.
17.9 Recurring payments and refunds
For subscriptions subject to automatic renewal, the Customer authorizes recurring charges only when this method has been clearly indicated and accepted before the Order is placed. The terms, frequency, amount, and methods for preventing renewal are governed by the article concerning subscriptions and recurring supplies. Any refunds are made in accordance with the provisions of these General Terms relating to Order cancellation, the right of withdrawal, non-delivery, and the statutory warranty. As a rule, the Seller issues the refund using the same method used for the initial payment, unless otherwise agreed as permitted by law and provided that the Customer does not incur additional costs.
18.1 The invoice is issued in the cases provided for by applicable tax regulations or when it is validly requested by the Customer within the deadlines established by law. For purchases of Goods made through the Website by a Consumer Customer, the invoice is not issued automatically, unless it is required by law or requested by the Customer no later than the time the transaction is carried out for tax purposes.
18.2 To enable the Seller to process the request correctly, the Consumer Customer must select the relevant option during the purchase process and provide all required tax details before submitting the Order.
18.3 If the option to request an invoice is not available at checkout, the Customer must send the request to the Seller using the contact details specified in Article 1, in any event no later than the deadline established by tax regulations for carrying out the transaction. Requests submitted after the statutory deadline cannot be accepted through the late issuance of an invoice, except where tax regulations permit rectification or a different document procedure.
18.4 For purchases made by Professional Customers, the invoice is issued in accordance with the obligations and procedures established by applicable law. The Professional Customer must request it and provide the relevant details during the purchase process.
18.5 For the purpose of issuing the invoice, the Customer must provide, according to their status and place of residence, the details requested by the Website, including, where applicable:
18.6 The Customer guarantees that the tax details provided are complete, truthful, accurate, up to date, and relate to the person in whose name the invoice must be issued.
18.7 Before submitting the Order, the Customer must carefully check the tax identification number, VAT number, name, address, and any data required for electronic transmission. The Seller shall not be liable for incorrect issuance or the inability to transmit the invoice correctly where such circumstances result from inaccurate, incomplete, or outdated data provided by the Customer, without prejudice to the obligation to make corrections permitted by law.
18.8 The invoice is issued in electronic format and transmitted through the Sistema di Interscambio of the Italian Revenue Agency, in the cases and according to the procedures established by applicable law. The electronically issued invoice relevant for tax purposes is the document transmitted to and accepted by the Sistema di Interscambio, unless otherwise provided by law.
18.9 When the invoice is issued to a Consumer Customer, the Seller shall also make available or transmit a readable copy of the invoice, in paper or digital format, unless the Customer waives this right in cases permitted by law.
18.10 Any copy transmitted by email or made available in the personal area serves as a readable copy of the electronic document and does not replace the original tax document transmitted through the Sistema di Interscambio.
18.11 The Customer may also consult the electronic invoice through the services made available by the Italian Revenue Agency, in accordance with the procedures and conditions established by that Administration.
18.12 Any failure to deliver the electronic invoice to the electronic address indicated by the Customer does not necessarily mean that the document was not issued, provided that the invoice was duly transmitted to the Sistema di Interscambio and made available in accordance with the procedures provided for by tax law.
18.13 The invoice is issued on the basis of the data provided by the Customer and the information resulting from the Order at the time the transaction is carried out. After the invoice has been issued and transmitted, it is not possible to directly modify the document already issued, freely replace the name of the addressee, or correct data that the Customer should have verified before submitting the Order.
18.14 Any errors must be promptly reported to the Seller using the contact details indicated in Article 1 and specifying:
18.15 Where the correction is permitted or required by tax law, the Seller shall proceed by means of a variation note, a new document, a reversal, or another procedure permitted for tax purposes. The Customer's request does not guarantee that the invoice can be modified or reissued in another name. The Seller shall assess the correction based on the nature of the error, when it was reported, and the procedures permitted by tax law.
18.16 Replacing the original invoice holder with a different person after the transaction has been carried out is not normally permitted, unless this is due to a documentable error and the correction is permitted by law.
18.17 The cancellation, modification or total or partial refund of the Order may result in the issuance of the corrective tax documents provided for by applicable legislation.
18.18 In the event of withdrawal, return, cancellation, price reduction or refund, the Seller carries out any resulting tax formalities without the Customer having to submit a specific request, unless additional information is required. If an invoice has not been requested or does not have to be issued, the Seller records and documents the transaction in accordance with the tax provisions applicable to the type of sale carried out.
18.19 The Order confirmation, payment receipt, transport document, courtesy copy and any other commercial documents sent to the Customer do not constitute an invoice, unless they are expressly designated and issued as such in accordance with tax legislation.
18.20 In the case of purchases intended for persons residing or established outside Italy, the Seller applies the invoicing, territoriality and tax documentation rules provided for by national and European Union legislation, taking into account the nature of the Customer, the Product and the destination country.
18.21 Tax data and documentation relating to transactions are retained for the periods required by law and processed in accordance with the privacy policy available on the Website.
19.1 The Seller delivers the Products to the address indicated by the Customer during the purchasing procedure, using the carriers and methods available at checkout. The destinations served, any territorial restrictions, shipping methods and related costs are indicated on the Website before the Order is submitted. The Customer must provide a complete and accurate address and ensure that they or an appointed person is present for delivery. The Seller is not liable for delays attributable to inaccurate or incomplete information provided by the Customer.
19.2 Any preparation and delivery times indicated on the Website or in the Order confirmation are estimates, unless a specific time limit has been expressly agreed as essential.
19.3 For Consumer Customers, unless otherwise agreed, delivery takes place without undue delay and in any event within thirty days of the conclusion of the Contract. Where applicable, the time limits run from receipt or confirmation of payment. The Customer is promptly informed in the event of significant delays.
19.4 The Order may be delivered in one or more shipments, without additional costs not previously communicated to the Customer. In the event of a partial shipment, the Seller informs the Customer of the Products shipped and those still to be delivered.
19.5 When available, the Seller sends the Customer the tracking number or a link through which the shipment status can be followed. Tracking information is provided by the carrier and may be subject to updates or technical delays.
19.6 Delivery is deemed completed when the Customer, or a third party designated by the Customer other than the carrier, obtains physical possession or control of the Products.
19.7 For international deliveries, the Customer is informed before placing the Order of the destinations served, the available costs, and any longer delivery times. Shipments to non-EU countries may be subject to customs duties, import taxes, and customs charges payable by the recipient, unless already included in the price.
19.8 Any delays caused by the carrier, customs authorities, force majeure, or other circumstances not attributable to the Seller will be communicated to the Customer as soon as possible, without prejudice to the rights granted by law in the event of non-delivery.
19.9 Digital Content and Digital Services are not subject to the delivery methods provided for in this article and are supplied by means of access, activation, or download as indicated in the relevant information sheet.
20.1 Shipping costs are calculated based on the destination, weight, and dimensions of the Products, the delivery method, and any applicable promotional conditions. The relevant amount is indicated in the Order summary before its final submission.
20.2 Standard rates, serviced destinations, and any free-shipping thresholds are published in the relevant section of the Site. Free shipping applies exclusively when the conditions indicated therein are met.
20.3 Any minimum threshold for free shipping is calculated based on the value of the Products actually purchased, net of discounts, cancellations, and returns, unless otherwise indicated.
20.4 Additional costs may apply to deliveries to remote locations, minor islands, remote areas, or destinations subject to carrier surcharges; these costs will be clearly communicated before the Order is submitted.
20.5 Shipping costs to foreign countries are determined based on the destination and are shown at checkout before the purchase is completed.
20.6 For shipments between countries belonging to the European Union, customs duties are not normally applied, without prejudice to the taxes and tax rules applicable to the sale.
20.7 For deliveries to countries or territories outside the European Union, customs duties, import taxes, customs clearance fees, or other charges imposed by the authorities of the destination country may apply. Unless the checkout expressly indicates that such amounts are included in the price, import charges shall be borne by the Customer or recipient and collected by the customs authorities, carrier, or appointed intermediaries.
20.8 The Seller cannot determine in advance the amount of charges imposed by foreign authorities. The Customer is advised to verify whether such charges apply before placing the Order. Refusal to pay customs charges or collect the shipment may result in the Products being returned to the Seller. In such case, the refund may be reduced by the direct, actual, and documented costs of shipping, storage, customs clearance, and return, within the limits permitted by law.
21.1 Delivery is made to the address indicated by the Customer in the Order. The Customer must verify its accuracy and ensure their own presence or that of an authorized person. The number of delivery attempts and the relevant procedures depend on the service of the selected carrier. If the recipient is absent, the carrier may leave a notice, make another attempt, or deposit the shipment at a collection point or storage facility.
21.2 The Customer must follow the instructions provided by the carrier and collect the shipment within the indicated deadline. Any address errors must be promptly reported to the Seller. A change is not guaranteed if the Order has already been prepared or handed over to the carrier.
21.3 If delivery is not possible due to an incorrect or incomplete address, repeated absence, failure to collect, or another cause attributable to the Customer, the Products may be held in storage and subsequently returned to the Seller.
21.4 Failure to accept or collect the shipment does not, in itself, constitute the exercise of the right of withdrawal, which must be communicated in the manner provided for in these General Terms and Conditions.
21.5 After the Products have been returned, the Seller may agree with the Customer on a new shipment. The related costs shall be borne by the Customer when the previous failed delivery was attributable to the Customer. If a new shipment is not agreed upon, the Seller may cancel the Order or terminate the Contract and refund the amounts due, deducting only the direct, actual, and documented costs of shipping, storage, and return, within the limits permitted by law.
21.6 No penalties or flat-rate charges may be applied if they were not previously disclosed or do not correspond to costs actually incurred. The refund will be issued without undue delay using the same payment method used by the Customer, unless otherwise agreed without resulting in additional costs.
21.7 If the failure to deliver is attributable to the Seller, the appointed carrier, or an error not attributable to the Customer, the Customer will not incur any additional costs. The Seller will arrange a new delivery or issue a full refund of the amounts due.
21.8 The Consumer Customer's rights in the event of failure to deliver within the agreed or legally prescribed period remain unaffected.
22.1 With respect to the Consumer Customer, the risk of loss of or damage to the Products transfers when the Customer, or a third party designated by the Customer other than the carrier, physically acquires possession of the Products.
22.2 If the carrier was chosen directly by the Consumer Customer and that choice was not proposed by the Seller, the risk transfers when the Products are delivered to the carrier, without prejudice to the Customer's rights against the carrier.
22.3 For Professional Customers, the transfer of risk is governed by the applicable legal provisions and any specifically agreed B2B terms.
22.4 Upon delivery, the Customer is invited to check:
22.5 In the event of visible irregularities, the Customer is invited to accept the delivery with a specific reservation, describing the problem encountered on the carrier's receipt, for example: "package opened", "wet packaging", or "damaged parcel". A general reservation without indicating the irregularity found may not be sufficient for the purposes of making a claim against the carrier. The Customer is invited to document the irregularity by photographing the packaging, shipping label, and Products and to retain them until the verification has been completed.
22.6 Damaged, incomplete, incorrect, or non-conforming Products must be promptly reported to the Seller using the contact details indicated in Article 1, specifying the Order number and the problem encountered.
22.7 Failure to make a reservation with the carrier or failure to report the issue immediately does not automatically result in the loss of the rights granted to the Consumer Customer under the statutory warranty of conformity.
22.8 The reservation and timely notification are required solely to facilitate the assessment of the damage and any action by the Seller against the carrier. Notifications concerning defective, damaged, incomplete Products or Products other than those ordered are handled in accordance with the provisions of these General Terms and Conditions concerning the statutory warranty and after-sales assistance.
22.9 The right of withdrawal is distinct from the remedies provided for damaged or non-conforming Products and may not be used by the Seller to limit rights arising from the statutory warranty.
Subject to the provisions on exclusions, the Consumer Customer may withdraw from the Contract without giving any reason within fourteen days. The Professional Customer does not have the right of withdrawal, unless otherwise expressly agreed with the Seller.
23.1 The fourteen-day period begins:
23.2 Withdrawal is exercised in a timely manner when the relevant communication is sent before the applicable deadline expires
23.3 The Consumer Customer may also withdraw from only some of the Products included in the same Order, provided that each Product is returned in its entirety
23.4 The conditions, procedures, effects of withdrawal, returns, refunds and exclusions are set out in the Information on the right of withdrawal, available on the Website and referred to in these General Terms and Conditions. The Information on the right of withdrawal in force at the time the Contract is concluded forms an integral part of these General Terms and Conditions.
The Consumer Customer may exercise the right of withdrawal, within the period specified in the preceding article, by making an explicit statement of their decision to withdraw from the Contract.
24.1 The communication may be sent by:
24.2 Use of the model form is not mandatory, provided that the declaration unequivocally expresses the intention to withdraw and makes it possible to identify the Customer, the Order, and the Products concerned.
24.3 Withdrawal is deemed to have been exercised within the time limit when the relevant notification is sent before the expiry of the fourteen-day period. The burden of proving that the right was exercised in a timely manner rests with the Consumer Customer.
24.4 For Contracts concluded through the Site, the Seller shall make available an online function clearly identified by the wording «Withdraw from the contract here» or other equivalent and unambiguous wording.
24.5 The digital function is easily accessible and available throughout the entire period during which the right of withdrawal may be exercised and allows the Customer to enter or confirm:
24.6 Before final transmission, the Customer must confirm the request using a function labelled «Confirm withdrawal» or equivalent wording. Following submission, the Seller shall, without undue delay, send the Customer, on a Durable Medium, a receipt containing:
24.7 The digital function constitutes an additional method and does not exclude the possibility of exercising the right of withdrawal through the other channels indicated in this article.
24.8 The instructions concerning the return of the Products are communicated by the Seller after receipt of the withdrawal declaration. Exercising the right may not be made conditional on stating the reasons for withdrawal.
After notifying the withdrawal, the Consumer Customer must return the Products without undue delay and in any event within fourteen days of the notification.
25.1 The deadline is met if the Products are shipped before the expiry of the fourteen-day period. The Products must be sent to: Editrice Shalom S.r.l. – Via Galvani n. 1, 60020 Camerata Picena (AN), unless the Seller communicates a different address in the return instructions.
25.2 Unless the Seller has declared that they will bear them, the direct costs of returning the Products shall be borne by the Consumer Customer, provided that this information was communicated before the conclusion of the Contract.
25.3 The Customer is advised to use a trackable shipping method and retain the relevant receipt until the refund process is complete. The Products must be returned complete with the accessories and documentation received. The original packaging, where present, must be retained and returned when necessary to properly protect or identify the Product.
25.4 The Consumer Customer may handle the Product only to the extent necessary to establish its nature, characteristics, and functioning.
25.5 The Customer is responsible for any decrease in value resulting from handling beyond what is necessary, such as damage, wear, alterations, torn or stained pages, broken binding, missing accessories, or damage to the packaging where it constitutes an essential part of the Product. Opening the packaging does not automatically result in the loss of the right of withdrawal, except in cases of exclusion provided for by law.
25.6 If a decrease in value is found, the Seller shall inform the Customer and may deduct a proportionate amount from the refund, documenting the condition of the returned Product.
25.7 Defective, transport-damaged, incorrect, or non-conforming Products are not handled as a simple withdrawal and remain subject to the rules governing the legal guarantee, with no return costs charged to the Customer.
26.1 In the event of a valid exercise of the right of withdrawal, the Seller shall refund the Consumer Customer all payments received for the Products concerned, including the costs of the initial standard delivery. Additional costs resulting from the choice of a delivery method more expensive than the least costly standard method offered by the Seller shall not be refunded.
26.2 The refund shall be made without undue delay and in any event within fourteen days from the day on which the Seller is informed of the decision to withdraw. Unless otherwise expressly agreed, the refund shall be made using the same payment method used for the purchase and at no cost to the Customer.
26.3 In the case of payment on delivery or through a system that does not allow the payment to be credited back, the refund will be made by bank transfer or another agreed method, upon communication of the necessary details.
26.4 The Seller may suspend the refund until the Products have been received or until the Customer demonstrates that they have shipped them back, whichever occurs first. This suspension does not apply when the Seller has offered to collect the Products directly.
26.5 Any decrease in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Product may be deducted from the refund in a proportionate and documented amount.
26.6 In the event of partial withdrawal, the price of the returned Products and any delivery costs directly attributable to them are refunded, without duplication or refunds exceeding the amounts actually paid.
26.7 The refund does not affect any additional rights to which the Consumer Customer may be entitled under applicable law.
27.1 The right of withdrawal is excluded in the cases provided for by Article 59 of the Consumer Code and, in particular, with regard to:
27.2 The exclusion applicable to a specific Product is clearly indicated in the relevant information sheet and in any event before the Order is submitted.
27.3 For Digital Content and services, the Seller obtains the declarations and consents required by law and provides confirmation thereof to the Customer on a Durable Medium.
27.4 Opening a Product's packaging does not automatically result in the loss of the right of withdrawal, unless one of the specific exclusions provided for by law applies.
27.5 Complete information on the exclusions is contained in the Information Notice on the right of withdrawal available on the Website, in the version in force at the time the Contract is concluded.
28.1 Goods purchased by a Consumer Customer are covered by the statutory guarantee of conformity provided for by Articles 128 et seq. of the Consumer Code. The Seller is liable for defects in conformity existing at the time of delivery that become apparent within two years of that time.
28.2 The Goods are compliant when, in particular:
28.3 Unless proven otherwise, a defect that becomes apparent within one year of delivery is presumed to have existed on that date, unless that presumption is incompatible with the nature of the Good or the defect.
28.4 In the event of a lack of conformity, the Consumer Customer is entitled, free of charge, to have conformity restored by repair or replacement, at their choice, unless the requested remedy is impossible or entails disproportionate costs compared with the alternative.
28.5 Repair or replacement shall be carried out:
28.6 The Seller bears the costs necessary to restore conformity, including shipping, transport, labor, and materials.
28.7 The Consumer Customer may obtain a proportionate price reduction or terminate the Contract when:
28.8 The Consumer may not terminate the Contract where the defect is minor. The Seller must prove that the defect is minor. In the event of termination, the Customer returns the Good at the Seller's expense, and the Seller refunds the price after receiving the Good or proof of its return. The Customer must report the defect to the Seller using the contact details indicated in Article 1 and make the Good available for inspection and application of the requested remedy.
28.9 There is no two-month forfeiture period from discovery of the defect. Actions to enforce claims for defects not fraudulently concealed become time-barred twenty-six months after delivery.
28.10 The warranty does not cover damage resulting from improper use, neglect, accidents, normal wear and tear, or unauthorized interventions, where such circumstances caused the problem identified.
28.11 Any commercial warranties offered by the manufacturer or the Seller are in addition to the legal warranty and do not limit its scope.
28.12 This warranty is reserved for Consumer Customers. The provisions of the Civil Code and any agreed B2B terms apply to Business Customers.
29.1 The Seller may offer Digital Content and Digital Services, such as ebooks, audiobooks, electronic publications, multimedia files, and digital subscriptions.
29.2 Before purchase, the information sheet indicates:
29.3 Supply takes place without undue delay after the conclusion of the Contract or receipt of payment, unless a different period is indicated in the Order.
29.4 The Customer is responsible for ensuring the availability of devices, programs, and a connection that comply with the technical requirements communicated before purchase.
29.5 The Seller provides the updates, including security updates, necessary to keep the Digital Content or Digital Service in conformity for the period provided for by the Contract and applicable legislation.
29.6 The Customer is required to install updates within a reasonable period. The Seller is not liable for defects resulting solely from failure to install them, provided that the Seller informed the Customer of their availability and the consequences of failing to install them, and that the instructions provided were adequate.
29.7 The Digital Content or Digital Service conforms when it corresponds to the description, has the agreed functionalities, and is suitable for the uses normally intended for digital products of the same type.
29.8 In the event of non-supply, the Consumer Customer invites the Seller to perform. If the Seller fails to do so without undue delay or within the agreed period, the Customer may terminate the Contract in the cases provided for by law.
29.9 In the event of a lack of conformity, the Consumer Customer is entitled to have conformity restored, free of charge and without significant inconvenience. If restoration is impossible or disproportionate, is not carried out within a reasonable period, or the defect is serious or persistent, the Customer may obtain a proportionate price reduction or terminate the Contract, in accordance with applicable legislation.
29.10 Any modification to the continuously supplied Digital Content or Digital Service is permitted only in the cases provided for by the Contract and by law, at no additional cost and subject to prior notification of the Customer. The Customer's remedies remain unaffected if the modification negatively affects use.
29.11 The provisions of this article apply to Consumer Customers. The specifically agreed conditions and applicable legislation apply to Business Customers.
A Customer who receives a Product that is damaged, incorrect, incomplete, or does not conform to the Order must report it to the Seller using the contact details indicated in Article 1.
3.1 The report must indicate, where possible:
30.1 The Seller may request only the information and documentation reasonably necessary to verify the report and identify the applicable remedy. The Customer is invited to retain the Product, accessories, and packaging until the checks have been completed, without the absence of the original packaging automatically resulting in the loss of rights granted by law.
30.2 The Seller informs the Customer of the procedures for returning or collecting the Product. Where the legal guarantee applies, the related costs are not charged to the Consumer Customer.
30.3 In the event of an incorrect or incomplete Product, the Seller provides, depending on the circumstances, delivery of the correct Product, completion of the missing items, or other remedies provided by law.
30.4 In the event of a lack of conformity, the remedies governed by Article 28 apply, including repair, replacement, price reduction, or termination of the Contract.
30.5 Reporting a damaged, incorrect, incomplete, or non-conforming Product is distinct from exercising the right of withdrawal.
30.6 The right of withdrawal allows the Consumer Customer to terminate the Contract within the statutory time limits even in the absence of defects; the legal guarantee, on the other hand, concerns Products that do not have the required characteristics.
30.7 The Seller may not automatically classify a request concerning a lack of conformity as withdrawal, nor charge the Customer costs that, by law, are borne by the Seller.
30.8 Failure to make a reservation at the time of delivery does not automatically result in the loss of rights arising from the legal guarantee.
The Customer may request assistance or submit communications and complaints by:
31.1 The communication must indicate, where applicable, the Customer’s name, the Order number, the Product concerned, and a clear description of the request or problem encountered.
31.2 The Seller may request only the information and documentation reasonably necessary to verify the report, such as photographs of the Product or packaging.
31.3 The Seller confirms receipt of the complaint and responds within a reasonable period, generally within fifteen working days. If further checks are necessary, the Seller informs the Customer of the status of the case.
31.4 Communications relating to the Contract are sent to the contact details provided by the Customer during the purchase. The Customer must keep them accurate and up to date.
31.5 The Seller retains records of communications and complaints for the time necessary to handle them and comply with legal obligations, in accordance with personal data protection legislation.
31.6 Filing a complaint does not limit the Consumer Customer’s right to exercise the right of withdrawal, make use of the legal guarantee, or seek other remedies provided by law.
32.1 The Customer must provide complete, truthful, accurate, and up-to-date information, particularly their contact details, delivery addresses, and tax details.
32.2 The Customer is responsible for the consequences arising from inaccurate or incomplete information attributable to them and must promptly report any changes.
32.3 The Customer undertakes to use the Site exclusively for lawful purposes and in compliance with the law, these General Terms and Conditions, and the rights of the Seller and third parties.
32.4 The following are prohibited:
32.5 Account credentials are personal. The Customer must safeguard them diligently and not disclose them to unauthorized persons.
32.6 The Customer must promptly inform the Seller in the event of lost credentials, unauthorized access, fraudulent use of the account, or unrecognized Orders.
32.7 The Customer is responsible for activities carried out through their account only when attributable to them. They are not responsible for security breaches or unauthorized use attributable to the Seller or its suppliers.
32.8 If there is a well-founded suspicion of fraud, abuse, or violation of these General Terms and Conditions, the Seller may suspend the account or Order processing for the time necessary to carry out the checks.
32.9 The Seller may close the account or refuse to accept the Order in the event of unlawful or fraudulent use, notifying the Customer and refunding any amounts collected.
32.10 Account suspension or closure does not limit the Consumer Customer’s right to exercise the right of withdrawal, the legal guarantee, or other mandatory rights provided by law.
33.1 The Seller is responsible for the proper performance of the obligations arising from the Contract in accordance with applicable law.
33.2 Nothing in these General Terms and Conditions excludes or limits the mandatory rights of the Consumer Customer, nor the Seller's liability in cases where it cannot be excluded by law.
33.3 The Seller is not liable for non-performance or delay when it demonstrates that they result from an event not attributable to it, unforeseeable and unavoidable through ordinary diligence.
33.4 The following may constitute force majeure events, by way of example:
33.5 Events attributable to organizational deficiencies, negligence or failure to adopt measures reasonably expected of the Seller do not constitute force majeure. In the event of force majeure, the Seller shall inform the Customer without undue delay, indicating, where possible, the nature of the event and the foreseeable effects on the Order.
33.6 Performance of the Contract may be suspended for the strictly necessary period. The Seller shall take reasonable measures to limit the delay and resume performance as soon as possible.
33.7 If the impediment is permanent or continues beyond a reasonable period, the Customer may request cancellation of the Order or termination of the Contract for the unperformed part, with a refund of the relevant amounts.
33.8 In the event of the temporary unavailability of the Website or technical services, the Seller shall take reasonable measures to restore their operation. The unavailability does not affect Orders already concluded or the Customer's rights.
33.9 The Seller is not liable for malfunctions exclusively attributable to the device, connection or programs used by the Customer, unless they result from inaccurate technical information provided by the Seller.
33.10 The Seller remains responsible for the delivery and conformity of the Products, refunds and other obligations required by law.
34.1 The Website and all related content, including trademarks, names, logos, text, images, photographs, illustrations, graphics, catalogs, product sheets, editorial works, excerpts, audio files, videos and digital content, are protected by intellectual and industrial property laws.
34.2 Such content belongs to the Seller or its respective rights holders and is used by the Seller on the basis of valid rights or authorizations.
34.3 Access to the Site and purchase of the Products do not grant the Customer any ownership rights over the protected content.
34.4 The Customer may use the content exclusively for personal and non-commercial purposes, within the limits permitted by law and these General Terms and Conditions.
34.5 Without the prior written authorization of the rights holder, it is prohibited to:
34.6 Uses expressly permitted by law remain allowed, including those relating to quotation, criticism, review, and teaching, within the limits and subject to the conditions established by applicable law.
34.7 The purchase of Digital Content grants the Customer only a personal, non-exclusive, and non-transferable right of use, unless otherwise indicated in the Product description.
34.8 Any violations may result in account suspension, removal of unlawfully used content, and pursuit of the remedies provided by law.
35.1 The Seller processes the Customer’s personal data in compliance with Regulation (EU) 2016/679, Legislative Decree 196/2003, and applicable law.
35.2 Information on the processing of personal data, including purposes, legal bases, retention periods, recipients, and data subject rights, is contained in the Privacy Policy available on the Site.
35.3 Specific information may be provided in relation to:
35.4 The data necessary for the performance of the Contract and compliance with legal obligations must be provided by the Customer. Failure to provide such data may prevent registration, conclusion of the Order, or its execution.
35.5 Any consents for promotional purposes, profiling, or optional services are requested separately and may be withdrawn in accordance with the procedures set out in the Privacy Policy.
35.6 The data may be disclosed to parties that provide services necessary for managing Orders, such as technology providers, payment service providers, carriers, consultants, and competent authorities, within the limits indicated in the Privacy Policy.
35.7 The Customer may exercise the rights granted under data protection legislation by using the contact details indicated in the Privacy Policy.
36.1 The Consumer Customer is invited to submit any complaints to the Seller in advance using the contact details indicated in Article 31, in order to allow the dispute to be resolved directly.
36.2 If the complaint is not resolved, the Consumer Customer may contact a competent alternative dispute resolution body for consumer disputes (ADR), listed in the registers provided for by the Consumer Code.
36.3 ADR procedures allow an attempt to settle the dispute out of court through impartial and independent bodies, in accordance with the conditions and fees applied by each body.
36.4 Information on recognized ADR bodies is available on the institutional website of the Ministry of Enterprises and Made in Italy and of the other competent authorities.
36.5 If the Seller participates in a specific ADR body or is required to use one, it shall inform the Customer of its name, contact details, and the address of its website. Recourse to an ADR procedure does not limit the Consumer Customer's right to refer the matter to the competent judicial authority, unless otherwise provided by mandatory provisions of law.
36.6 The Seller does not include any link to the former European ODR platform, which has been permanently discontinued under European Union legislation.
37.1 These General Terms and Conditions and the Contracts concluded through the Website are governed by Italian law. For a Consumer Customer habitually resident in another country, the choice of Italian law does not result in the loss of the protection afforded by the mandatory provisions of the law of the country in which the Consumer has their habitual residence, where applicable.
37.2 For any dispute relating to a Contract concluded with a Consumer Customer, jurisdiction shall lie with the court of the place where the Consumer resides or is domiciled, if located within the State, unless the Consumer chooses a different court permitted by law.
37.3 For disputes with Business Customers, the Court of Ancona shall have exclusive jurisdiction, unless otherwise agreed in writing or unless a different mandatory jurisdiction is provided for by law.
37.4 The possibility of using alternative dispute resolution mechanisms and all other mandatory protections granted to the Consumer Customer shall remain unaffected.
38.1 The Seller may amend these General Terms and Conditions to adapt them to regulatory, technical, organizational or commercial changes. The amendments shall take effect on the date of publication on the Website, indicated together with the number of the updated version. Each Order shall be governed by the General Terms and Conditions in force and accepted by the Customer at the time it is submitted.
38.2 Subsequent amendments shall have no retroactive effect and shall not affect Contracts already concluded, unless imposed by mandatory statutory provisions or expressly accepted by the Customer.
38.3 The Customer may view, download and retain the updated version of the General Terms and Conditions available on the Website.
39.1 If one or more provisions of these General Terms and Conditions are declared null and void, ineffective or unenforceable, in whole or in part, the remaining provisions shall remain valid and effective.
39.2 The invalid or ineffective provision shall be replaced, to the extent permitted by law, by the applicable statutory provisions or by a valid provision that reflects, as far as possible, its original purpose.
39.3 In dealings with the Consumer Customer, the mandatory provisions established by the legislation protecting the Consumer Customer shall remain applicable in all cases.
39.4 Any failure or delay by the Seller or the Customer to exercise a right provided for by these General Terms and Conditions or by law does not constitute a waiver of that right.
39.5 Any tolerance of conduct contrary to these General Terms and Conditions does not prevent the interested party from subsequently requiring compliance with them.
39.6 Any waiver of a right is valid only if clearly expressed and, where required, made in writing.
39.7 These General Terms and Conditions, together with the specific conditions of the Order and the documents expressly referred to, constitute the contractual terms applicable to the purchase.
These General Terms and Conditions are drafted in Italian, which constitutes the applicable contractual language. Any translations into other languages are provided solely to facilitate consultation. In the event of discrepancies in interpretation, the Italian text shall prevail, without prejudice to the mandatory rights of the Consumer Customer.
These General Terms and Conditions enter into force on 01/01/2026 and apply to Orders submitted from that date onward.
